Please read this Privacy Policy carefully. By checking the acceptance box on the intake form, you confirm that you have read, understood, and agree to the terms of this Privacy Policy. If you do not agree, please do not use the Platform.

"User","you", or "your" refers to any individual who accesses or submits an intake form on the Platform.
"Personal Information" refers to any information that identifies or can be used to identify you, including personal data such as mental health-related information you provided in your intake form.
"Therapist" refers to independently licensed mental health professionals listed on the Platform.
"Services" refers collectively to all features, tools, matching, booking and session facilitation offered through the Platform.

Information We Collect

When you submit the intake form on the Platform, we collect the following Personal Information directly from you.

Email address
Phone number
Gender
Age
Whether it's your first time in therapy
Mental health related responses provided in the intake form
Therapist Preference
Session booking details

You acknowledge that you are providing this Personal Information of your own free will for the purpose of accessing our Services. You have the option to not provide us with the requested information, however in such cases we may not be able to provide you with our Services.

The Let It Out Feature

Our Platform includes a "Let It Out" space where you may type freely to vent or express yourself. Anything you enter into this pace is not transmitted to, collected by, seen by, or stored by heliopause.care in any form. The content is cleared from view as soon as you click the release button and is never saved or reviewed by us. Please note that, as with any text entered into a web browser, we cannot control how your own device, browser, or any browser extensions you have installed may handle what you type. This feature is not linked to your intake form, booking, or any other Personal Information you may have provided.

How We Use Your Information

We use your Personal Information for the following purposes:

To match you with a Therapist
To facilitate session booking, confirmation, and reminders
To send you session-related communications, including but not limited to video conferencing links via email
To send you follow-up emails after your session
To respond to support request and grievances
To improve our Platform and Services using anonymous, non-identifiable data
To comply with applicable laws and legal obligations
To detect and protect against fraud, errors, and other harmful activity

We do not use your Personal Information for any marketing or promotional communications.

What We Do Not Do With Your Data

Heliopause.care does not sell, trade, rent or otherwise transfer your personal information to third parties for commercial purposes. We only share your data with third-party service providers who assist us in operating our platform and delivering our Services, and only to the extent necessary for those purposes. These providers process your data solely to perform the function we rely on them for, and do not access, read, or use your information for any other purpose. All such providers are required to handle your data responsibly, keep it confidential, and comply with applicable privacy laws and the data processing agreement we maintain we them

We may disclose your Personal Information when required to do by law, court order, or competent authority to protect rights, property, or safety of heliopause.care, our Users, or others.

Visitor information that is not personally identifiable may be used in anonymized or aggregate form for platform improvement, research, and audit purposes.

Authorized personnel of heliopause.care may access your intake form responses and booking details where necessary to perform manual Therapist matching, respond to support requests, and manage your sessions. Such access is limited to what is necessary for these purposes and is subject to the same confidentiality obligations described in this Privacy Policy.

Therapist Profile Sharing

As part of the matching process, you will be shown the profile of your matched Therapist, including their name, photo, credentials, specialization, and experience, so that you can make an informed decision before booking a session.

Third Party Tools and Data Processors

To deliver our Services, heliopause.care works with carefully selected third-party service providers who may process your Personal Information on our behalf. For third-party providers have been selected with data security as a priority and operate under assigned Data Processing Agreements: A formal contract that legally binds a third-party to handle your data securely, confidentially, and only for the purposes we specify. We share only the minimum information necessary with each provider. The categories of third-party processors we use are as follows:

Cloud-based data storage: Your intake form responses and session details are stored securely within a cloud-based data storage provider
AI Processing: To facilitate Therapist matching, your intake form responses maybe processed by an AI system that analyzes your responses and suggests a suitable Therapist. Your name, email address, and phone number and not shared with the AI system, only the response relevant to matching are processed. In some cases, matching is performed manually by our team rather than by the AI system. We only share only the minimum information necessary for matching purposes.
Scheduling and Communication tool: We use a scheduling and and communication platform to manage session booking confirmations and reminders. Your name, email address, phone number and session details are processed through this platform.
Workflow automation tool: User workflow automation platform to trigger and manage communications after sessions. Your name and email address and processed through this platform as part of this automated platform.
Payment Gateway: All payments are processed through a secure third-party payment gateway. Your payment information is processed directly by the payment gateway and is not stored by heliopause.care at any point.
Video Conferencing Platform: All Therapy sessions are conducted via third-party video conferencing platform. Your name and email address are used to generate and send session links. Sessions are not recorded by heliopause.care at any point.
Analytics providers: We use analytical tools to understand how Users interact with our Platform. These tools collect anonymous usage data. They do not collect your name, email, or any personally identifiable information.
Website hosting:
Our Platform is hosted on Wix, which may independently collect technical data such as IP address, browser type, device type, and pages visited as part of standard website hosting and analytics operations. This data is collected and processed by Wix. Please refer to Wix's Privacy Policy for more information.

Some of the third-party services described above operate under their own terms of service and privacy policies. Where you interact directly with a service, your use of that service is also subject to its own terms and privacy policy, over which heliopause.care has no control.

Cross Border Data Transfer

After Heliopause.care is an Indian Platform operated by Heliopause Solutions from India. Some of the third-party service providers we work with store and process your data on servers located outside India. All such providers are globally recognized platforms trusted by businesses and organizations worldwide, and operate under signed data processing agreements with Heliopause.care, ensuring your Personal Information is handled securely and responsibly at all times, regardless of where its processed. By checking the acceptance box on the intake form, you consent to your Personal Information being transferred to and processed by third-party service providers in accordance with the Privacy Policy.

Cookies

Our Platform is hosted on Wix, which uses cookies as part of standard website operations. Cookies are small data files stored on your device that help improve your browsing experience. Heliopause.care doe snot independently set or manage cookies. For more information on the cookies used, please refer Wix's Privacy Policy.

Log Data

When you visit the platform, Wix's servers automatically record certain technical information, such as your IP address, browser type, device type, operating system, and pages visited. This is a standard procedure followed by virtually every website you visit on the internet and is an inherent part of how websites operate. This log data is collected and managed by WIx as part of their hosting services and is not directly collected or controlled by heliopause.care.

Confidentiality and Its Exceptions

Your Therapist is committed to maintaining the strict confidentiality of all information shared during therapy sessions, in accordance with their professional and ethical obligations. heliopause.care maintains confidentiality of the Personal Information that it collects and will not disclose it to any third-party except as outline in this Privacy Policy or as required by applicable law. As heliopause.care does not access or store the content of therapy sessions, such content remains solely between you and your Therapist. There are limited circumstances under which a Therapist may be legally or ethically obligated to breach confidentiality. These include, but are not limited to:

A credible risk of harm to the User or to others.
Disclosure required by a court of low or any competent authority.
Knowledge of any criminal activity, including abuse of minors, senior citizens, or disabled persons.
Any other situation mandated by applicable laws.

Such decisions are made solely at the Therapist's professional discretion and in accordance with their licensing and ethical obligations, heliopause.care has no role in and bears no responsibility for any such disclosures made by a Therapist.

Data Retention

We retain your Personal Information for a period of three years from the date of your last interaction with the Platform. After this period, your personally identifiable information is either securely deleted or irreversibly anonymized. Any anonymized data that we retain beyond this period cannot be used to identify you and is kept solely for aggregate analytics, research, and platform-improvement purposes. Where we are legally required to retain identifiable data for a longer period under applicable law, we will do so only for as long as required.

Based on your responses, you are matched with a Therapist, either through our AI-assisted matching system or through manual matching by our team. Please note that, despite our reasonable efforts to delete your data, there may be residual information that remains within our databases or those of our third-party processors. Such residual data may be held within systems that are not immediately accessible for deletion. This residual data will be deleted as and when it becomes technically feasible to do so and will not actively used for any purpose.

Consent Withdrawal

You have the right to withdraw your consent to the collection, storage and processing of your Personal Information at any time by contacting us at privacy@heliopause.care. Please note that withdrawal of consent will restrict our ability to provide you with our Services. Upon withdrawal, any upcoming sessions you have booked will be cancelled, and such cancellations will be handled in accordance with the Cancellation, Rescheduling & No-Show Policy set out in our Terms. Following withdrawal, we will be unable to assist with any support queries relating to the Personal Information or sessions in question, as the relevant data will not longer be available to us. Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal.

Updating Your Personal Information

If your Personal Information changes if you need to correct any information that you've provided, please contact us at privacy@heliopause.care. We will make all reasonable efforts to update your information within a reasonable period of time. If you would like to delete your data entirely, please refer to Your Rights section below.

Security

Heliopause Solutions employs reasonable administrative and technical measures to protect your Personal Information from unauthorized access, use, disclosure, or loss. We work with third-party processors that maintain industry standard security practices. However, no method of data transmission or storage is completely secure. While we strive to protect your Personal Information, we cannot guarantee absolute security. You are solely responsible for ensuring the security of your own email account and phone number so that they cannot be access by unauthorized third parties.

Heliopause.care uses your email and phone number as primary communication channels for session confirmations, links, and reminders. Heliopause.care shall not be liable for any breach in confidentiality should your email or messages be accessed by third party with or without your consent. We strongly discourage you from sharing session links, booking details, or any Personal Information in any publicly accessible place.

If you access our Services through a third-party platform, including but not limited to the video conferring platform or payment gateway, and a data breach occurs due to acts or omissions of that third-party platform, Heliopause.care shall not be held liable for such a breach. You agree to indemnify Heliopause.care against any such data breaches arising from third-party platforms used in connections with our Services.

Your Rights Under the DPDP Act 2023

Under the Digital Personal Data Protection Act, 2023, you have the following rights with respect to your Personal Information.:

Right to access: You may request a summary of the Personal Information we hold about you.
Right to correction: You may request correction of inaccurate or incomplete Personal Information.
